City of Rochester, NY Official Arrested for DWI After He Hit a Vehicle Three Times In a McDonald's Drive-Thru, Had Drunk at Least a Fifth of Jack Daniels

Charles Benincasa, the City of Rochester, NY Finance Director who was busted for DWI on March 3, 2016,          appeared in court on Thursday and entered a plea of not guilty.

In court, details of his arrest were released.

And, as it turns out, when I called Benincasa a drunk in my original piece (below), I was right on the money.

You see, Charles Benincasa was so lit, that he backed up, and crashed into a car at a McDonald's drive-thru, not once, not twice, but three times.

According to court papers, the 59-year old Benincada, who was appointed by Rochester, NY Mayor Lovely Warren, left the scene after crashing into the vehicle three times, only to return to the same McDonald's located on Culver Rd. and East Main St. in Rochester, and this time, entering the wrong way into the drive-thru lane, and then leaving the parking lot again.

That's when Rochester Police officer Rickey Harris spotted Benincasa driving  down Ohio St. where Benincasa nearly hit a curb and according to court documents, was "swerving in and out of the southbound lane."

According to police reports, when officer Harris pulled Benincasa over on University Avenue near Oliver Street, officer Harris "could smell alcohol coming out of the car."

Officer Harris's report also states that "The male also had slurred speech."

Court papers indicate that at this point New York State Police took over the traffic stop, and that Charles Benincasa told troopers that he had left his home in Webster, NY, a suburb of Rochester, and had driven to a liquor store, and was heading home when he was pulled over.

Benincasa also told New York State Police trooper J.L. Faugh that he had been drinking Jim Beam at his home.

According to Trooper Fough's report, she then spotted "an almost empty fifth of Jack Daniels" in Benincasa's car.

Faugh's report goes on to describe how when she was talking to Charles Benincasa, outside of his vehicle, he fell back and braced himself, by putting his hands against her cruiser. "I asked him what he had to drink from the liquor store and he stated 'just one drink.' I asked what type of drink and he stated 'Jack Daniels'."

Trooper Faugh also reviewed surveillance footage from McDonald's cameras which captured the collisions, but according to court papers, Benincada "denied being in a crash."

Yep.

He was lit alright.

Like one of the readers of this blog posted on Twitter,   "Yea you know you're lit when you smile for ya mugshot like "oh it's nothing" lmao."

In court, the Judge suspended Charles Benincasa's drivers license.

Benincasa is due back in court in April.

For at least the third time in Rochester, NY Mayor Lovely Warren's administration, one of her top officials has been arrested and charged with DWI.

This time it's City of Rochester Finance Director Charles Benincasa.

Benincasa, 59 was drunk when he was driving on Rochester's east side Thursday night when he was pulled over and arrested by New York State Police, who charged him with DWI.

In April of 2014, Rochester, NY Deputy Mayor Leonard Redon was drunk when he got behind the wheel of his Audi TT and was speeding on Interstate 490 east with an expired inspection when he was pulled over and arrested by New York State Police, and charged with DWI.

Rochester, NY Deputy Mayor Leonard Redon had a blood alcohol content level (BAC) of .13, nearly twice the legal limit.

A month later, in May of 2014, City of Rochester, NY Director of Neighborhood and Business Development Spencer Ash, who was previously an attorney for the City of Rochester, was arrested and charged with DWI by Rochester Police after he crashed his Mercedes just after 2 a.m., and then got into an argument with a Rochester cop.
