Rochester, NY Taxpayer Dollars at Work: When RPD officers Hang Out at Donut Shops, Taxpayers Foot the Gas Bill

Some may have read my last piece, about Rochester, NY Police officers Tony Belliard and Garth Mitchell harassing a hard working, single mother over parking. (For those who may not have read my piece, I have included the link below).

Well, in part, it was that piece, which prompted me to document something she said, something I, and many of you have been aware of, when it comes to Rochester, NY Police officers leaving their cruisers running, wasting gas, gas that taxpayers pay for, while they frequent coffee shops, restaurants, and other hangouts.

Or as the woman who was harassed by RPD officers Tony Belliard and Garth Mitchell said,, "while they're inside sucking on coffee and slamming donuts down their throats..."

So, since Rochester Police officers enjoy bullying and harassing innocent hard working tax paying citizens, I decided to document some of their coffee sucking, donut slamming, while leaving their cruisers running antics.

Below I've posted a couple of videos.

The first is of Rochester Police cruiser E-42, left running outside Dunkin' Donuts located at 1691 East Ave. for nearly an hour Thursday morning, while several officers sucked and slammed inside.

If you notice in the video, not only was the cruiser left running, but the officer must have really been in a rush to slam that manager's special donut, because he also left his wipers running.

Another interesting thing is that the officers parked their cruisers in a parking lot adjacent to the Dunkin' Donuts shop.

A parking lot which actually belongs to Public Storage, a self storage business, NOT Dunkin' Donuts.

And I said "officers" because there was at least another RPD cruiser, E-107 also parked in the storage business parking lot.

But wait, it gets better.

As proof that Rochester, NY Police officers leaving their cruisers running is no fluke or random thing, but rather normal everyday practice, as you can see in the video below there was yet another Rochester Police cruiser E-76, left running in the McDonald's parking lot, which is next door to the storage business.

Now I know there will be some who will say cone on give them a break, they deserve to have a coffee and a donut, or two.

That's not my point with this piece.

My point is the following,

In a city which is ranked the 5th poorest city in the U.S., taxpayers should be disgusted that not only are their hard earned dollars paying for Rochester, NY Police officers to sit around sucking coffee and slamming donuts, but they should be disgusted that these same Rochester Police officers could care less about leaving their cruisers running, sometimes for hours at a time.

After all, why should they care?

They're not paying for the gas.

You are.

Rochester, NY Police officers Tony Belliard and Garth Mitchell Harass Woman over Parking

With one of their own officers, Sgt. Anthony Bongiovanni, under investigation for shooting his own friend early Monday morning, drugs, rapes, robberies, and increasing homicides, including a triple murder, you'd think that the Rochester, NY Police department would have better things to do than to harass a hardworking, tax paying city resident and African-American single mother, over parking.

That's right.

Parking.

Here's the story.

The woman who contacted me Tuesday afternoon, asking for my help, and who asked that I not use her name for fear of retaliation by Rochester Police, shared the following with me.

Employed as a professional truck driver whose job includes driving out of state, she has been parking her day cab, (without a trailer), which she takes home every day, in front of her North Winton Road home.

A day cab is smaller than a regular cab as it doesn't have a sleeper compartment.

The woman usually parks her cab in a corner parking lot which is always empty, however with the recent snowfalls, she stopped parking there, in order not to get stuck, since the lot is often not plowed.

That's when she parks in front of her home, where there aren't any " NO PARKING" signs, or any alternate day parking restrictions whatsoever.

In fact, parking is always allowed on both sides of the street.

She has been doing this for several months, with no problem, since September.

Until Monday night.

Around 10:00 p.m.

That's when Rochester, NY Police officer Anthony "Tony" Belliard showed up to her home, where she and her children were asleep, and began pounding on her front door.

When she answered the door, officer Belliard asked if the truck parked in front of her home was her truck.

She replied that it was.

Officer Belliard then told her that she could not park in front of her home.

She explained that she has parked her truck there on and off, depending if her regular parking spot, which is the parking lot has been plowed or not.

She explained to officer Belliard that it's never been a problem.

"Well you can't park there anymore," Belliard said.

The woman then told officer Belliard that she didn't understand why, especially since not only has she parked there for months, without any issues, but also that there aren't any parking restrictions on either side of the street.

She then proceeded to tell officer Belliard that to avoid any issues, she would just park the cab in the parking lot, like she always has.

"No, you can't park there either," replied Belliard.

Belliard then asked the woman for her phone number, and told her that he would call her.

Sometime Tuesday morning, while the woman was at work, Rochester Police officer Garth Mitchell came to her home and left a card with his name and number asking that the woman call him.

When she got hone from work, she called but got officer Mitchell's voicemail.

She left a message.

A few hours later, Rochester, NY Police officer Tony Belliard called the woman, who at that point asked Belliard why another officer had come to her home, all over a parking issue.

Belliard told the woman he didn't know.

At that point the woman informed officer Belliard, that not only was all this so petty and ridiculous, all over parking, but that after Friday, it wouldn't matter anyways, since she was moving.

"Where are you moving to?" officer Belliard asked the woman.

The woman did not answer.

"Are you moving in the city, or out of the area?" asked officer Belliard.

"Out of the area," the woman replied.

I asked the woman how she felt that in a city which claims to want to attract people to move into the city, that the Rochester Police department would go out of their way to harass someone, over parking.

"I feel that it's so petty, seeing that it was only temporary due to the fact that I only parked there due to the weather," she said, adding, "I get so sick and tired of seeing cops at coffee shops with their cruisers left running outside while they're inside sucking on coffee and slamming donuts down their throats when they should be out there trying to solve crime."

"Keep in mind, I work hard, I am not on any kind of public assistance, I feel bad because I'm watching my tax dollars at work, so many crimes go unsolved, but yet they have time to sit around or harass people."

So there you have it Rochester, NY taxpayers, your hard earned tax dollars at work, the Rochester Police department harassing hardworking, tax paying, single mothers.

Over parking.

So the next time you call 911 to report open air drug dealing, and you see that the Rochester, NY Police department doesn't respond, now you see why.

They're too busy bullying, and harassing innocent people.

Over petty parking issues.

Rochester, NY Cop Shoots Friend

There are alot of questions to be answered after a Rochester, NY Police officer shot and seriously wounded his own friend early Monday morning.

Here's what the Rochester, NY Police department says happened.

Rochester, NY Police Sgt. Anthony Bongiovanni was "startled" when his "friend", 51-year old Chuck Andrews, of South Carolina, entered Bongiovanni's home at 436 South Avenue around 5:25 a.m.

Rochester Police say Sgt. Bongiovanni's friend was trying to "visit" him.

According to Rochester Police, Sgt. Bongiovanni then grabbed his own "legally registered" firearm, and shot his "friend" in the torso, before realizing he had just shot his "friend".

Andrews is listed in guarded condition after undergoing surgery.

That was the Rochester, NY Police department's version of what transpired before dawn at one of their officer's home.

I suppose there are many who will blindly believe anything the Rochester, NY Police department says, including their spins and lies in order to protect one of their own.

I also know there are many who will blindly believe Rochester's Corporate-America run mainstream news media, who always find a way to help law enforcement, especially the Rochester Police department's spins lies and cover ups.

Don't Get a Flat Tire in Brighton, NY

Yes, you read the title correctly.

Don't get a flat tire in Brighton, NY.

But if you do, beware of Brighton, NY Police officer Richard Kosakowski, who apparently has nothing better to do than to harass hardworking innocent tax paying citizens.

Like my niece and nephew's mother.

She got a flat tire, and was just a few blocks away from a gas station Thursday around 2 p.m., with her emergency four way flashers on, when she was pulled over by officer Kosakowski.

Officer Kosakowski, who has been with the Brighton Police department since March of 2013 after transferring from the Utica, NY Police department, then issued her an equipment failure citation, which is different than a regular traffic infraction in that with an equipment failure type citation, the person has 24 hours to correct the issue, then they provide a police officer or court with a signed form showing that the issue has been corrected, and that usually takes care of it.

Which she did.

But that's not the point.

The real issue here is that Brighton, NY Police officer Richard Kosakowski went out of his way to stop a woman with a flat tire and four way flashes on.

And on a list of the most petty traffic stops a cop can make, stopping someone for havinf a flat tire has got to be up there on the list. 

The real issue here is that Brighton, NY Police officer Richard Kosakowski went out of his way, not to assist a taxpayer with a fiat tire, but instead to harass  her.

The real issue here is that in a town plagued by robberies, including car and  home break ins while families are asleep, and in a town which doesn't want to admit that youths from affluent families spray paint anti-Semitic racial slurs and swastika symbols in font of homes on tree lined streets, Brighton, NY Police officer Richard Kosakowski is a petty, over zealous cop who apparently feels his time and authority is better used picking on and harassing women.



Note: I called the Brighton, NY Police department and spoke to Lieutenant Ronald Ward, who I must say was very professional and courteous.

I told him how petty I thought it was for one of his officers to go out of his way to stop an innocent woman on her way to a gas station with a flat tire.

He didn't say much.

But he listened.

And then he spoke.

"Davy, I can't speak to why the officer did what he did."

Wegmans Food Markets Exposed; According to a Manager, Company Commits Tax Fraud Daily

To many, especially in Rochester, NY, the name Wegmans evokes positive thoughts and feelings.

And why wouldn't it?

The privately owned food market chain was founded in 1916 and has grown to over 80 stores in New York, Pennsylvania, New Jersey, Maryland, Massachusetts, and Virginia.

Wegmans has been featured in Fortune Magazine's "100 Best Companies to Work For", every year, since the magazine's inception in 1998.

In 2007, Food Network selected Wegmans for its "Best Grocery Store" award.

Then, in 2012 Consumer Reports named Wegmans, the "Top U.S. Grocery Chain".

Well, according to a Wegmans upper level management member, there are dark secrets behind the company's wholesome, family run business image.

One of them being tax fraud.

We met at a local coffee shop.

The management member, who has been with Wegmans for over 15 years, and who follows my blog, contacted me Tuesday morning.

He said he wanted to talk to me, on the condition that I not publish his name.

"Wegmans is committing tax fraud, every single day," the man said, in between sips of his coffee.

"It's common practice."

As I took notes on my legal pad, the man shared the following with me.

Every single day, truckloads of merchandise from companies such as General Mills, Snyder, Swift, and ABF arrive at the Wegmans Food Market warehouse, located at 1500 Brooks Ave. in Gates, NY, a suburb of Rochester.

The truck drivers back their trailers up against the receiving docks of the warehouse, then disengage the cab from the trailer.

Up to this point, it seems as though it's just a normal, warehouse delivery of goods, right?

Well, as you'll soon see, that's all about to change.

According to the management member, here's where Wegmans commits tax fraud.

Here's the catch.

Those Wegmans employees, WILL NOT be clocked in on Wegmans time.

They will be off the clock.

On their own personal time.

But make no mistake, they will be paid, and when you read how they're paid, I'm sure you'll be surprised.

Referred to as "lumpers", the off the clock Wegmans employees will start to unload the trucks, while the driver pulls his cab into a designated parking space, and waits.

The off the clock Wegmans employees will not only unload the merchandise, but also rearrange, or "break down" some of the merchandise, forming other pallets.

Ok, so by now you're probably saying, where's the tax fraud?

Here it is.

When the "lumpers" are done "lumping" the trucks, they will go to the truck driver, who will pay them.

In cash.

A lumper can make an average of around $200 to $250 per truck.

Tax free.

How?

Well, when the truck driver pays the "lumpers", he or she will have the lumper sign a slip with their full name and social security number.

The lumpers will write a fake name, and a fake social security number on the slip, in order not to have declare the 'under the table' tax-free income to the IRS.

According to the management member, it is also common for Wegmans employees to come in to the warehouse on their day off, just to lump.

For example, if an employee is off on a Monday, he will come in at the regular truck times which are 5 a.m., 2 p.m., and 10:30 p.m.

If you notice, these intervals are about 8 hours apart, meaning that a lumper can work as much as a full shift, off the clock, and make tax-free cash.

Depending on loads and trailers, a lumper can make anywhere between $500 and $2,000 in an 8-hour 'shift'.

Once the lumper is paid, they will often break off an average of $20 to $35 cash to the Wegmans receiving manager, and forklift operator, or "clamp guy", both who remain on Wegmans time.

And there you have it, tax fraud, being committed on a daily basis, by WegMans Food Markets, Fortune Magazine's "100 Best Companies to Work For."

Shame on Nestor Ramos for Praising Former Rochester, NY Police Chief James Sheppard, a Two-Faced, Hypocrite Coward

Rochester, NY Democrat and Chronicle newspaper editorial writer Nestor Ramos' twitter profile photo is that of the Star-Trek Starship Enterprise.

It's actually quite fitting since Ramos' latest column is pure fiction.

Ramos is not from Rochester, and it shows.

In his February 9th column titled "Great news for RPD - with a few caveats", Ramos praises former Rochester, NY Police Chief James Sheppard, who retired a couple of months ago after mayor Lovely Warren called the Chief to tell him his services were no longer needed.

In his piece, Ramos, who sounds like a cheerleader for Sheppard, and who at several points in his piece seems to be pushing for Sheppard to get his old job back (since Lovely Warren has yet to find a permanent replacement to head the RPD, almost 45 days into her administration), disrespects minorities, such as himself, by praising a coward, whose actions, or lack thereof, of failing to put a stop to an out of control police force, infested with racist and rogue cops, have hurt countless innocent African-Americans and Latinos in Rochester.

"Maybe she was out looking for a police chief. As it happens, I know a good one who's available."

Nestor Ramos that Rochester will not find a better police chief than Sheppard.

"I doubt we'll find a better candidate." Ramos writes.

So, Nestor Ramos, since you are an outsider to Rochester, by way of New Haven, Connecticut, Pittsburgh, Portland, Oregon, and Sioux Falls, South Dakota, and since your lack of knowledge of my hometown's corrupt police force is so evident in your "Beam me up Scottie" writing, let me educate you, mi hermano, on who James Sheppard, the coward you praised, really is.

Like I said, as Rochester, NY Police Chief, James Sheppard was a coward.

A complete failure.

Sheppard lacked the skills a true leader needs.

You see Nestor, a true leader has LEADERSHIP skills.

Something Chief James Sheppard NEVER had.

A true leader has INTEGRITY.

Something Chief Sheppard NEVER had.

A true leader has RESPECT.

Something Chief Sheppard NEVER had.

A true leader does not allow himself to be a PUPPET.

Like Chief Sheppard did.

As a black man, in a city with the rich history of civil rights struggles that Rochester, NY has, where Frederick Douglass and Susan B. Anthony sacrificed so much, (and who by the way are both buried in Rochester's Mount Hope Cemetery), Rochester Police Chief James Sheppard will be remembered as a Chief who not only condoned, but encouraged, his disproportionately white police force, to racially profile, abuse, and violate African-Americans and Latinos' civil rights.

Like he did when Rochester Police officers Anthony Liberatore, Joseph Ferrigno, and Mitchell Stewart II pepper sprayed and beat Benny Warr, a wheelchair confined, one-legged amputee who was waiting for the bus at the intersection of Jefferson Ave. and Bartlett St.

The officers claimed that Warr disobeyed their order for him to move, even though he was in his motorized wheelchair, on a public sidewalk, waiting for the bus.

RPD Chief James Sheppard immediately justified, and supported his officers' criminal actions.

Not surprising, since the officers were actually enacting Chief Sheppard's "Operation Zero Tolerance", where innocent citizens, including the handicapped, and disabled, are constantly subjected to illegal, unconstitutional stops, searches, seizures, and assaults, by rogue, over zealous RPD cops.

As a black man, Rochester Police Chief James Sheppard will be remembered as a Chief who justified the beating of Brenda Hardaway, a pregnant African-American woman who was driven, stomach first, into a wooden porch railing post, punched in the head, and thrown to the ground by Lucas Krull, a white Rochester Police officer.

As Chief, James Sheppard will be remembered as a Chief who approved, and justified Rochester Police officer Mario Masic violating Emily Good's Constitutional rights, by arrestng her after she exercised her first amendment rght, videotaping Masic conducting a racially-profiled traffic stop of an African-American motorist.

As Rochester Police Chief, James Sheppard called the modern-day firing squad execution of Israel "Izzy" Andino, a mentally-ill young man, shot by 7 Rochester Police officers, justified, before the investigation had even begun.

In his piece, Nestor Ramos gives Sheppard a platform to spew more lies and hypocrisies, even saying that as Chief he was "transparent" which could not be any further from the truth.

Nestor Ramos should be ashamed of himself to not only give praise to a coward, who many, including myself believe he has been hands down, the worst RPD chief in recent years, but for Ramos to also suggest that Sheppard should be rehired as RPD Chief, is asinine.

Ramos makes Sheppard sound like some hero cop, who is devastated that he lost his job.

"This is my healing process," Sheppard is quoted in Ramos' piece, as he talks about his cross-country trip to reunite with relatives, since retiring from the RPD.

Really?

His healing process?

What about the healing process of the families of all the innocent people, especially African-Americans and Latinos, who have been harassed, profiled, abused, and in some cases executed by the very same officers you lead Chief?

The very same officers whose rogue, criminal, gang-like behavior and atrocities Sheppard coveted.

And condoned.

When does their healing process begin?

And Nestor, here, maybe you will understand if I put it in Spanish.

Rochester, NY Police officer Blinds me and my Children with Cruiser's Spotlight, Causes Two Car Crash, then Speeds Off

While waiting at a red light at the intersection of Buffalo Rd. and Glide St, a Rochester, NY Police west division officer, stopped at the same red light but heading in the opposite direction as me, turned on his cruiser's spotlight, pointed it directly at my vehicle, blinding me and my family, including my 2 sons, my 4-year old daughter and my niece.

It all happened around 7:15 pm, Thursday evening, as I was returning from taking my son and niece to dance class.

Not knowing why the RPD officer was blinding me and my family with his spotlight, which he kept on us even after the traffic light had turned green, I stood still, not moving forward.

Like I always tell people, when coming into any contact with law enforcement, whether it's being pulled over, questioned, or in this case, having a huge floodlight shone right at me and my family, the important thing is to remain calm.

NEVER give a law enforcement officer ANY reason to think that you are trying to evade him or her, or have anything to hide.

Then I heard a loud crashing sound directly behind me.

A car had been hit in the rear end by another car.

At that same moment, the RPD officer sped away, not even stopping to see if anyone was injured.

I pulled my vehicle to the side of the road, at which time both of the other drivers had gotten out of their cars.

Both drivers, a middle aged woman, and man, almost in unison, asked me the same question.

"Why did he shine the light on you like that?"

"And he just kept on going," said the man.

A few minutes later another Rochester Police cruiser who happened to be driving by, stopped and turned on his emergency lights.

That officer was RPD Sgt. Bello.

Sgt. Bello came up to me and asked me what happened.

He asked me for my name.

"I've heard the name," Sgt. Bello said, 

"I'm familiar with your work."

I explained to him that an officer blinded me with the spotlight and not knowing why, or what was going on I remained standing.

I asked Sgt. Bello if he knew who that officer was.

Sgt. Bello said he did not.

I gave Sgt. Bello my card and told him I wanted the officer's name.

I told Sgt. Bello that the officer's actions were reckless.

Not only did the officer's unwarranted, and obvious unnecessary actions shining a spotlight on me and my children, cause me to remain standing and not proceed, as I thought I was being stopped, but then for the officer, a first responder, to have left the scene of a motor vehicle accident, something me or you would be charged for, was completely irresponsible and unprofessional.

Sgt. Bello then looked at me and said, " I don't know why the officer did that, I will ask around and see if anyone raises their hand and admits it was them."

Sgt. Bello told me I was free to go.

I got in my vehicle and told my frightened children that everything was ok.

New York State Police Uses Facebook to Attract Snitches

Calling all snitches!

The New York State Police has turned to Facebook in hopes that you will help them catch warrant suspects.

They're calling it Warrant Wednesdays.

Every Wednesday, New York State Police will post photos of individuals with warrants out for their arrest.

According to New York State Police, they are hoping the community will get involved and locate those individuals for them.

In other words, snitch.

I mean let's call it what it really is.

Warrant Wednesdays is the latest example of law enforcement using social media and the internet's power and reach, in hopes that people will snitch.

I wonder if they will provide tipsters and their families with protection.

Of course not.

Rochester, NY Man Bites Brother's Ear Off a la Mike Tyson During Super Bowl Party

In the latest 'WTF? News', a Rochester, NY man is behind bars after cops say he bit chunks of his own brother's ear off during a fight, during a Super Bowl party.
According to police, Sean Fallon-Nebeia got into a fight with his 26-year old brother, Frank Fallon-Nebeia Saturday night, when in the middle of the fight he went Mike Tyson on his brother, biting several pieces of his ear off.

Sean Fallon-Nebeia was arraigned in Rochester City Court Monday morning where he pleaded not guilty.

He is being held in jail in lieu of $15,000 cash bail or bond.

According to the criminal complaint against Sean Fallon Nebeia, who is charged with felony first-degree assault, both brothers had drank more than a bottle of whiskey, while watching the game.

Breakups are never easy.

It's never fun to have to gather your belongings, and pack your car up.

Especially when you're leaving your own home.

Well, imagine if during the course of you loading your things up into your vehicle, your significant other starts arguing with you and begins yelling, threatening to take the license plates off your vehicle because even though the title is on your name, the registration is in hers.

She then calls the police.

Then, shortly after the police arrive, an officer beats you viciously, while his partner stands by watching.

That's exactly what happened to Dwayne Ivery on August 17, 2013 right in front of his home, located at 1509 East Main St.

As Ivery was talking with his girlfriend, Rochester, NY Police officer Alexander Baldauf became irate.

"I thought I told you not to say anything!" Baldauf yelled at Ivery.

Rochester Police officer Baldauf then grabbed Dwayne Ivery's hand, and punched him in the head.

Officer Baldauf then continued to punch Ivery, who can be seen in the video trying to protect himself from the beating, trying to retreat.

Officer Baldauf then pins Dwayne Ivery down, where the beating continues.

At one point during the beating, RPD officer Baldauf stomps on Dwayne Ivery's head with his boot.

The whole time, Rochester, NY Police officer Ricky J. Harris Jr. stood by watching.

At no point in time intervening in the vicious beating of an nnocent man, by his partner,

Ivery, who was charged with aggravated harassment and resisting arrest, suffered multiple injuries as the result of RPD officer Baldauf's beating, including a fractured nose.

Thanks to the power of video, the whole incident was captured on Mr. Ivery's home surveillance video system. (I have included the video below)

Ted Forsyth, of Rochester Indymedia and Enough is Enough, was first to report on this disturbing incident.

Forsyth sent me a press release announcing a press conference on Tuesday February 4, 2014, where Dwayne Ivery, along with his attorney, Charles F. Burkwit, will formally announce the filing of a lawsuit against the Rochester, NY Police department and the City of Rochester.

In addition to the Rochester Police department and the City of Rochester, the lawsuit names former RPD Chief James Sheppard as well as RPD officer Ricky J. Harris Jr.


Update:

Rochester, NY Mayor Lovely Warren and her administration, including City Corporation Counsel T. Andrew Brown declined comment.

Phillip Seymour Hoffman was a Real Person

Oscar winning actor Phillip Seymour Hoffman, 46, was found dead in his Manhattan, NY apartment Sunday.

It is believed he died as a result of a drug overdose.

A native of Fairport, NY, just outside Rochester, Hoffman, won an Oscar for his role the 2005 film Capote.

One of my favorite Hoffman roles was as Freddy Lounds in the 2002 film Red Dragon, in the Hannibal Lecter series.

But what I liked most about Hoffman was the fact that he was a real person.

He was down to earth. 

Not pretentious.

Not arrogant.

When he won the Oscar, Phillip Seymour Hoffman exchanged high fives with people in his neighborhood.

Hoffman would walk his children to school.

Public school.

No entourage.

No big deal.

Just a dad walking his kids to school.

His neighbors didn't think of him as some big Hollywood celebrity.

Because he didn't act like one.

They considered him a regular guy.

Because he was.

In an entertainment world where attitudes, arrogance, arrests, and drama seem like the norm, Phillip Seymour a Hoffman was a welcomed change.

He was a real person.

And as a real person, he had real issues.

He was fighting his demons.

Among them, a drug addiction.

And yet, watching Hoffman on the big screen, one would never even know it.

Which is usually the case, when one fights the demons.

People don't suspect the pain the lies behind a smile.

May his death bring more awareness to the serious illness that drug addiction is.

Rest in peace Phillip Seymour Hoffman.

Thank you for your great talent.

But most of all, thank you for being a real person.
