Good Ol' Boys Club Practice Behind 9 Livingston County, NY Jail Deputies Falsifying Business Records

Blue wall.

Code of Silence.

Five well known, and well used words to describe the disturbing Good Ol' Boys Club 'Hear No Evil, See No Evil, Speak No Evil' culture that permeates through the law enforcement profession.

And it's that same culture that allowed 9 Livingston County, NY Jail deputies defraud taxpayers by lying, and falsifying business records in what has come to be known as the "Shift-Swapping Scheme."

In essence, in order to get days off,  full-time Livingston County, NY Jail deputies would pay cash to part-time jail deputies, in exchange for those part-time deputies working their shift for them.

The full-time deputies would fill out their work time sheets, falsely making it appear that they had worked their full shifts, when in reality, they were paying the part-time deputies to work.

After an 18-month investigation into the time card fraud, Friday afternoon, the 9 Livingston County, NY Jail deputies were arrested by New York State Police.

Arrested and charged with one count each of 2nd Degree Offering a False Instrument for Filing, were; 
Jose Agosto Jr., Marvin Yamonaco Jr., Andrew Eichhorn, Tom Schledorn Jr., Jeremiah Pratt, Mike Simpson, William "Billy" Baker, Kyle Fisher, and Tim Fraser.

Monday morning, 8 out of the 9 Livingston County, NY Jail deputies pled guilty in Livingston Town Court.

The 9th deputy,  Andrew Eichhorn pleaded guilty to the initial charge of offering a false instrument for filing, and could face up to a year in jail, when he's sentenced on July 8.

But this case doesn't end here.

Many questions remain unanswered.

Questions such as what about the Livingston County, NY Jail superiors?

Certainly more than just these 9 men must have known what was going on right?

Absolutely.

In fact, this "Shift-Swapping", and falsifying business records has been going on in Livingston County for at least the past 20 years.

Its a well known practice.

And, it's also well known that higher ups in the Livingston County Jail have known about this all along, but turned a blind eye to it, a la 'Hear No Evil, See No Evil, Speak No Evil'.

In fact, it's such a well known practice, that in a disturbing twist during Monday's guilty pleas, Livingston County, NY Judge Thomas Bushnell, was mad, and called the guilty pleas unfair, saying that the deputies were simply following orders.

While I find it very unsettling that a judge would be biased, and defend 9 corrupt jail deputies, who were part of a scheme to defraud taxpayers, I have to ask what about the superiors?

Where are their arrests?

Where are their charges?

And why did it take 18 months?

Apparently I'm not the only one asking that question.

Jason McGuire, Livingston County Conservative Party Chairman has criticsized the criminal investigation.

"I am concerned that it doesn't go far enough and it doesn't go high enough, you know essentially there are Corporals that are responsible in that jail for what occurs in that jail and to think that it's falling on the lower level guys and that somehow the corporals that signed off on what happened there didn't know about it, there's a problem there," McGuire said, adding, "I think a lot of people in Livingston County have been frustrated by that really it's been 18 months or more now and there's been concern over what is happening here, why aren't we getting faster action?" 

"I hope that the District Attorney will shine light on the situation and I think that's really what the people of this county are looking for."

And there you have it.

Law enforcement's Good Ol' Boys Club in action.

Eighteen months to catch 9 low on the totem pole corrupt jail deputies, while the big fish who not only knew about the corruption, and fraud, but allowed it to go on, got away.
